- Ripple CEO Brad Garlinghouse plans to initiate actions for an investigation into former SEC chair William Hinman, believing someone influenced Hinman’s speech on the ‘security’ status of cryptocurrencies.
- The recently released Hinman emails disappoint the XRP community as they don’t reveal much about XRP’s classification. The legal battle is likely to conclude soon.
In a bold step, Ripple CEO Brad Garlinghouse has confirmed that the blockchain startup will be initiating actions to ensure that the former SEC chair William Hinman is investigated. Garlinghouse believes that someone influenced Hinman to give the June 14, 2018, speech, wherein he talks about the ‘security’ status of cryptocurrencies.
Earlier this week, Ripple released the emails of the draft o Hinman’s controversial speech on cryptocurrencies. The document also shows that Hinman had ignored clear warnings as well as suggestions from top SEC officials to give the speech.
The officials, particularly the Head of Trading & Markets, cautioned Hinman that his speech would create more confusion in the market because it didn’t consider the Howey factors.
However, Hinman went ahead and delivered the speech at the Yahoo Finance All Markets Summit. During the speech, Hinman stated that a digital asset would no longer be considered a security if it becomes “sufficiently decentralized.” He specifically declared Bitcoin and Ethereum as non-securities based on this criterion.
Earlier this month, Ripple’s General Counsel Stuart Alderoty asked for an investigation as to who influenced Hinman to give the speech. He also questioned why the US SEC touted the speech knowing that it would create greater confusion.
Hinman Lied Under Oath, SEC Chair to Take Action
There have been major speculations that William Hinman was inspired by someone from the Ethereum team in order to deliver the controversial speech. Interestingly, the recently released Hinman emails show that the former director of SEC’s Corporation Finance used “Ether Speech” as the title of his first email.
Furthermore, Hinman reveals having a meeting with Ethereum co-founder Vitalik Buterin in order to understand the Ethereum network better. Additionally, there have also been speculations that Hinman was trying to give Ethereum a free pass which is why he ignored the SEC warnings from the beginning.
In a recent tweet, a prominent member of the XRP community, Mr. Huber (@Leerzeit), raised concerns and asked Ripple if they have any plans to address the issues mentioned by Alderoty, apart from simply requesting an investigation on Twitter. Responding to this, Garlinghouse said “Yes”. Here’s what the Ripple chief had to say further.
Trying something new – some thoughts from me on the events (specifically the release of the Hinman documents) of this week. For me, this has all had a personal bent to it – and felt like it warranted some personal comments. pic.twitter.com/k4dYeQGhsN
